1. The information we collect

When you make an enquiry. If you complete the enquiry form or contact us by email or social media, we collect your name, email address, phone number (if you give it), the country where you are based, the service you are interested in, who the enquiry is for, how you heard about us, and the content of your message.

When you become a client. If you go on to work with us, we collect the information needed to provide and invoice for our services, such as your billing address and payment details. Clinical information shared in sessions is held separately and is covered by the client privacy notice you receive before your work begins.

When you join our mailing list. If you choose to subscribe, we collect your name and email address.

When you visit the Website. With your consent, we collect information about how you use the Website, such as the pages you visit, your device and browser, and your approximate location, through cookies and analytics tools. See section 6.

2. Health information

Some of what you tell us in an enquiry, such as the reason you are getting in touch, may be information about your health. This is a special category of personal information under UK data protection law, and we treat it with particular care. We use it only to respond to your enquiry and to assess whether our services are right for you, on the basis that it is necessary for the provision of health care, and under the professional duty of confidentiality that applies to our work.

There is no need to share detailed personal or medical information in an enquiry. A few lines is enough.

3. Why we use your information, and our lawful basis

  • To respond to your enquiry, and to take steps at your request before you become a client: our legitimate interest in responding to you, and steps prior to entering a contract.

  • To provide our services and manage payment: performance of our contract with you, and our legal obligations, such as keeping financial records.

  • To send you our newsletter or updates: your consent, which you can withdraw at any time.

  • To understand how the Website is used and improve it: your consent, given through the cookie banner.

We do not sell your information, and we do not use it to make automated decisions about you.

4. Who we share it with

We share personal information only where necessary, with:

  • Service providers who help us run the Website and our practice, such as our website platform, email, booking and payment providers, who act on our instructions;

  • Our professional advisers, such as accountants and lawyers, where needed;

  • Other clinicians or specialists, only with your agreement, as part of your care;

  • Authorities or others where we are required to by law, or where disclosure is necessary to protect someone from serious harm.

5. Where your information is stored

Some of our service providers, such as our website platform and email provider, may store information outside the United Kingdom. Where this happens, we make sure appropriate safeguards are in place, as required by UK data protection law.

6. Cookies

Cookies are small text files placed on your device when you visit a website.

Essential cookies are needed for the Website to work, for example to remember your cookie choices. These are always on.

Analytics cookies help us understand how visitors use the Website, such as which pages are visited and for how long. We use these only if you accept them.

Marketing cookies may be set by social media or advertising platforms to show you relevant content elsewhere. We use these only if you accept them.

When you first visit the Website, a cookie banner lets you accept or decline non-essential cookies. You can change your choice at any time through the cookie preferences link in the footer, or by adjusting your browser settings. Declining non-essential cookies will not affect your use of the Website.

Some cookies are set by third parties, such as Google Analytics and social media platforms, whose own privacy policies apply. You can opt out of Google Analytics at tools.google.com/dlpage/gaoptout.

7. How long we keep your information

We keep personal information only for as long as we need it. Enquiries that do not lead to work together are deleted within 12 months. Client and financial records are kept for the periods required by law and professional guidance. Mailing list details are kept until you unsubscribe.

8. How we protect it

We take appropriate technical and organisational measures to protect your information against unauthorised access, loss or misuse. Information is sent through the Website over a secure, encrypted connection, and access is limited to those who need it. No method of transmission over the internet is completely secure, but we take care to keep your information safe.

9. Your rights

Under UK data protection law, you have the right to:

  • ask for a copy of the information we hold about you;

  • ask us to correct information that is inaccurate;

  • ask us to delete your information;

  • ask us to restrict or stop using your information, or object to how we use it;

  • ask for your information to be transferred to you or another organisation;

  • withdraw your consent at any time, where we rely on it.

To exercise any of these rights, email hello@kindlynow.com. There is no charge, and we will respond within one month. You can unsubscribe from our emails at any time using the link at the bottom of each email.

10. Professional and regulatory standards

As a psychology and psychotherapy practice, we work to the professional standards of the Health and Care Professions Council (HCPC) and handle personal information in line with UK data protection law and the guidance of the Information Commissioner's Office (ICO).

You also have the right to raise a concern about our use of your personal information with the ICO, at ico.org.uk or on 0303 123 1113.

11. Changes to this policy

We may update this policy from time to time. The date at the top shows when it was last changed. If we plan to use your personal information in a new way, we will tell you before we do.

12. Governing law and contact

This policy is governed by the laws of England and Wales. If you have any questions about it, please contact us at hello@kindlynow.com.
